Have you ever gotten your video ruined because the audio was disabled? Here's something that might help. I looked this up and found it on a few music videos that suposedly won their copyright disputes. It is a fair use copyright law. Anyway here you go. "Copyright Disclaimer Under Section 107 of the Copyright Act 1976, allowance is made for "fair use" for purposes such as criticism, comment, news reporting, teaching, scholarship, and research. Fair use is a use permitted by copyright statute that might otherwise be infringing. Non-profit, educational or personal use tips the balance in favor of fair use." Try putting it in your description, it may help. You could also try this as well- *ALL MUSIC AND LYRICS BELONG TO THEIR RIGHTFUL OWNERS* I used it on my video and it hasn't been copyright blocked yet. Huh, I might put this in my machinimas when I make them. YouTube hates Muse for some reason; they always take down videos with their songs in them (except DigitalPh33r's Deus Ex Machina series and earlier)
Thanks, i mean, I've tried this, and it doesn't work...at all. but thanks for trying. it sucks that the have to do this. I've had about 15 machinamas ruined because of this....any one got any other ideas?
Good idea. I have had some videos ruined by copyright, and I usually acknowledge the artist. Sucks I know, but the copyright law might work in our favor after all. YouTube has really been going down hill. That change they're going to make isn't going to help them any.
Youtube really shouldn't be taking matters into their own hands for this one. Personally, I wouldn't really mind if someone used my music for a fan video/cover, or anything else for that matter. As long as they aren't actually making money off of the video, there is no violation to any copyright or code. Movies and TV Shows, are a different story though...
You aren't making money, but YouTube is; because the ads on the page are making money while the record company's music is playing on the video. That's why record companies are getting so p/o'ed lately.
But the music is irrelevant. Regardless if I had Metallica playing on my video or some crappy song I made, Youtube would still make money off my video because of the advertisements. So, there should be no problem, Youtube isn't making money off of the actual music itself, but rather the advertisements on the page. It's like trying to compare tacos and robots....there's no relevance.
My friend who makes me videos for my maps recently put up a video of a really bad map, but it had music by Paul Stanley which was removed. He also had an account banned for music violation, he had tons of videos before the "removed for copyright" fiasco started, and when the found him, they banned him. I've also noticed that the bands that are not well known are better selection for music. My guess is that Youtube thinks that the song is created by the video poster or something so that there is no copyrights placed on the song. I'm not sure about that, though, but I've never seen a video with a song by a band like say, Cancer Bats, have its audio removed.
Once again, US government is moving the laws around to suit the labels. also, try metacafe or something.
Now all they need to do is make the video length longer! GRR. I think that if you are playing rock band, guitar hero, etc. they should not remove the audio for "Copyright" because technically, you are playing a game YOU BOUGHT/rented, with the fact that the band of the song sold their copyright to the company that made the game, hint Harmonix/Activision, it was by their will that they gave the song(s) to the games in the first place. Also, montage for Halo 3 should also not be blocked audio wise. Just my opinion.
I've pretty much realized at this point that this way doesn't work at all. I keep taking down videos even when they have this. I think the best this can do for you is help in a copyright dispute. Maybe we should create some kind of petition to send to youtube. NO MOAR COPEE RYTE AWDIO SWOPS!!! It probably wouldn't do anyhting, but it'd be worth a try.
If you're making a video based around a song, I can't help you, but if you're looking for music and already have the video done, go to freeplaymusic to download cool free music. And by free, I mean not LimeWire-free, but Non-licensed music...
My Jr. research paper had a bit of info on this, both youtube and myspace video use the method of, instead of removing a users video for copyright, they will add ads, that will give revenue to the compnays that own the song. But thats only for the compnays that allow youtube to use their songs in the first place, like WMG. http://www.youtube.com/press_room_entry?entry=vCfgHo5_Fb4 Also if a songs band is under UMG (universal music group) then you bet your ass its gonna be removed.
