Firstly I don't care if it even did look better and accusing you of stealing something for that reason would be absolutely trivial and childish. It's like you took the vista theme and add some grey circles on it and squared it off. The album art thing is a very basic tool. SO even if you did make it all you have to do is fill a black layer and set the opacity to whatever you feel necesary then add some grey circles? Oh and you typed out some letters? Now if you really did make this theme, give us a link to the deviantArt page with your name on it? ****ing retard...

Even if you did make this theme it's only a slight edit of themes I've seen before, it's simple and uncomplicated. You don't need to know any form of programming and you only need basic photoshop skills. Even that you don't need. This style of theme has been done to death and has exact duplicates all over the net so why would I not think you used it and called it your own.
