I agree, to a point. It is pretty ridiculous. But theres nothing we can do, except live with it. If you want to modify an xbox, then youll have to keep it to yourself.
I agree that it is pretty stupid that one device can be hacked, but not another. But in reality, are people going to be making their own xbox games? & Microsoft has made software and hardware to enable users to do that. Whether that be at a ridiculous price or not.
When you purchase an Xbox YOU own it. It's not like we fork out hundreds of dollars to pay a rental fee for a game console... This is probably one of the stupidest things I've ever heard. (Partially because I have a modded xbox myself, but I don't use it online) This really needs to be changed because it's not even really breaking any laws, yet somehow it is.

Dude, I own two xboxes. One which I game on regularly, the other I have modded to an extent. Ive tried to find ways around it. Loopholes e.t.c, but their T.O.U are pretty damn clear. Ive done my share of complaining, and it doesnt help. I had lots of motivation, but its gone. But hell, I guess Ill start complaining again, possibly on the xbox forums or something. Its completely allowed because WE bought the hardware. However, once we are connected to xbox live, we lease a spot saying we WILL NOT use a modded console to play online. This is pretty fair, considering the amount of grief we can get from online people who are Hacking/Modding. Modding does void the warranty, but so does Jailbreaking an Iphone etc. It may be legal, but it is against the ToU. Now as for that Techdirt article, I dont know. The above is only what I can gather with the information ive been handed.
The techdirt article is bias. Yes it is against the ToU. And the person who had problems was trying to publish a book on modding the xbox. There are obvious problems with profiting from xboxes being modded. As for the other person, they aren't giving details besides "modding an xbox", in order to maintain the bias. He's probably modding something significant, or profiting from the modding somehow.
I don't much care, I don't mod, but it's quite outrageous when you get jail time for altering a product you paid huge money for. I can understand this for games and such, but **** this is stupid.
Why do they take down ONE MAN who mods, when big sites like se7 and TTG make thousands off modding? Not directly, but that is where it all goes on. Microsoft is butthurt because modders though of charging people to be the highest level in mw2 before they did. Yes, I do mod. Yes I own a JTAG. Yes, I disagree with it being illegal. If modding my xbox is illegal, why isn't modding my ipod? My computer? Whoever said a revolution needs to happen, you sir are right. Creativity is meant to be shared. If you have an idea, who's to stop someone from using the basis of it do something else? /rant
Not surprising, this has happened a lot since xbox modding has been around. They don't care if you yourself mod your xbox, but they care about the people standing to make profit from modding other people's consoles. This case is nothing compared to some of the other ones out there, but it's not going to change. While we're the customers, they still have legal leverage against those who illegally (hence the word) mod other people's consoles. Is it bullshit? Yeah. Will it change? No. They stand to loose too much from allowing business like this going around. A lot of the time people mod their consoles to pirate games and cheat online. While I know there's a large group out there who just want to mod games (myself included), there's always that other half who ruins it for everyone else; which is their reasoning for not really condoning console modding. So I agree with it technically being against the rules, but I don't agree with people going to jail over it (though his sentence might be reduced to prevent overcrowding.. his offense is nothing compared to what other people are doing out there obviously). On the bright side, this won't really stop anyone. People will always look into how to mod consoles, and there will always be people out there who will mod your console (I wouldn't personally recommend it, though.. Just learn how to do it yourself, it's easy).
Im only against modding if it gives someone an unfair advantage. For instance, if you used that Jtag to make yourself invincible in a game, or install anything that lets you have a better advantage when playing online against other people, thats what should be banned. There are reasons to mod other than cheating. Jtags can be used to install Pc mods on xbox games for example. Mods that improve the quality if games.
He's being given jail time for selling modded xbox systems. Legally, you can do whatever you want to your equipment when you purchase it. However, when you try to sell that modified equipment for a profit, that's when this law comes into play. If you're modding for personal use, you have nothing to worry about.
Jail-breaking in this case means what? Making it so you don't have to pay to download XBLA titles and marketplace content? Or just making your xbox look cool?
I dont think the term Jailbreaking is used right in that case but nevertheless, Modded xboxes can have more use than just cheating at games and illegally downloading stuff.
Nope, that is also illegal. They just clarified that it's legal to hack your own ipod touch/iphone device.
